Santa Ana Man Convicted of Secretly Taping Other Men in Restroom at Mile Square Park and Santa Ana City Hall

Miguel Fabian was sentenced to 6 months in jail and 3 years' probation.

A former City of Santa Ana intern was convicted and sentenced Thursday for surreptitiously creating 64 videotapes of men with his cell phone of men while the victims were using restrooms at Mile Square Park and at City Hall in Santa Ana.

Miguel Ruiz Fabian, 24, of Santa Ana pleaded guilty to eight misdemeanor counts of disorderly conduct by unlawful viewing and was sentenced to six months in jail and three years' formal probation.

"We were more on the aggressive side on sentencing because of the conduct," Assistant District Attorney Brad Schoenleben said. "I don't know if you can ever know what's going on with someone to make them do something like that."

At the time of the crime, Fabian was an engineering student at California State Polytechnic University, Pomona and was an intern at the Santa Ana Public Works Department.

On 64 occasions over 23 days between Dec. 28, 2010, and May 31, 2011, Fabian used his cell phone video camera to secretly record men using the restroom at Santa Ana City Hall and the Santa Ana City Hall Annex as well as at Mile Square Park.

"[The incident at] Mile Square Park is more than just a small wrinkle in this case," Schoenleben said. "Mile Square Park bothers me just as much as City Hall. They both have their concerns. Mile Square Park bothers me, obviously, because you have a park there, and that's a whole other set of concerns."

On May 31, 2011, a victim looked down while using the restroom at Santa Ana City Hall, and observed a cell phone on the floor at the foot of his stall. He grabbed the phone, identified Fabian as the owner, and called 911.
